2. How and Why We Use Your Personal Data
We will only process your personal data where the law allows us to. Under the UK GDPR, the principal lawful bases we rely on to run our operations are:
- Legitimate Interests (Article 6(1)(f)): To assess your suitability as a plant operator, verify your safety tickets, and introduce your skills to construction contractors requiring site material handling support.
- Performance of a Contract (Article 6(1)(b)): To take steps at your request prior to entering into a temporary assignment contract, and to process weekly payroll.
- Legal Obligation (Article 6(1)(c)): To fulfill statutory compliance mandates, including running formal UK Right to Work checks and ensuring tax transparency.
3. How We Share Your Personal Data
We never sell your data. We strictly disclose data to third parties solely to secure your employment placement and manage payroll architecture:
- Prospective Clients & Contractors: Siting agents and commercial buyers will receive your verified qualifications, experience profile, and active card check PDFs.
- Invoice Financing & Back-Office Partners: We use white-labeled finance and payroll processing systems (such as Sonovate/Simplicity) to administer contracts, issue Key Information Documents (KIDs), and fund weekly payroll.
- Accredited Payroll Umbrellas: We share payment processing metrics exclusively with FCSA or Professional Passport accredited umbrella entities to guarantee full tax compliance and eradicate Joint & Several liability risks.
- Regulatory Bodies: If legally required by law or a court order (e.g., HMRC or health and safety enforcement).
4. Data Security & Storage
Your personal information is stored securely inside encrypted, cloud-based Applicant Tracking Systems (ATS) and secured cloud networks. Access is strictly limited to authorized personnel within OnlyForklift Ltd who have a genuine business need to access compliance and verification documents.
We employ industry-standard protocols to protect against unauthorized modification, disclosure, accidental loss, or data breaches.
5. Data Retention: How Long We Keep Your Information
We do not hold personal data indefinitely:
- Unsuccessful Candidates: If you register but are not deployed, we retain your records for a maximum of 16 months in case alternative, local commercial plant vacancies match your profile, or to handle compliance complaints.
- Placed Contractors: If you complete active shifts through us, your file forms part of your formal engagement records and will be safely archived for 6 years following contract termination to comply with UK corporate tax and financial accounting regulations.

Under UK data protection law, you hold comprehensive rights regarding your personal information:
- The Right to Access: You can request a copy of the personal information we hold about you at any time.
